Resumo: The tendency of international and Community law to enhance the value of culture through the development of legislation on the safeguarding of assets that attest to the cultural identity of peoples has found some resistance in the Italian system. Italy is a country rich in popular tradi- tions, a heritage to be preserved for future generations. But the Italian cultural heritage system is built mainly around material goods. There is no specific legislation dedicated to intangible cultural heritage. We will investigate the reasons for this, the current regulatory scenario and the need to preserve and enhance intangible heritage. To this end, we will examine the origin and evolution of the concept of cultural heritage in the Italian system, the attempts of the legis- lator to open up to intangible assets, the current regulatory framework after the Ratification of the 2003 UNESCO Convention. We will then see which safeguarding methods are suitable for intangible assets, the legislative competence, and MiBACT's work to include Italian intangible
